Offended me and insulted my mother!

Why I got angry with "Yaser Al Habib," who insulted `A'ishah (may Allah be pleased with her), the wife of the Messenger of Allah (peace be upon him) and the daughter of Abu Bakr As-Siddiq who accompanied the Messenger of Allah in the cave, and I want to sue him? Is it because he has a different thinking? Of course not, he has free will to believe as he likes. Is it because he has a different doctrine unlike mine? No, he has free will to adopt any doctrine he likes. Is it because he does not recognize the status of Abu Bakr, `Umar, Hafsah, and `A'ishah? No, he may declare what he likes.

 

However, I want to sue him because he insulted me personally and insulted my mother. Moreover, insult and defamation is incriminated by law and by Shari`ah.

 

As for the penalty of Shari`ah, it is as follows: "And those who accuse chaste women, and produce not four witnesses, flog them with eighty stripes, and reject their testimony forever. They indeed are the Fâsiqûn (liars, rebellious, disobedient to Allâh)." [Surat An-Nur: 23].

 

As for the legal punishment, it is the text of article 306 of Egyptian law to which I belong: "Any insult includes, in any way, offence to the honor or reputation, shall be punished by the conditions set out in Article (171) imprisonment for a term not exceeding one year, and a fine of not less than one thousand pounds and not more than five thousand pounds, or one of those two penalties."

 

The text of article 209 in the Kuwaiti law to which he belongs:

"Anyone attributes to someone; in a public place or within the hearing or sight of someone other than the victim, an incident requiring punishment to the victim or hurting his reputation, he shall be punished by imprisonment for a term not exceeding two years and a fine not exceeding two thousand "rupees," or one of the two penalties."

 

 Here a question arises, who has ever left someone insulted his religion, honor, or belief without punishment? Did the people of the Pre-Islamic Period tolerate those who insulted their false gods even though they are made of stones and wood? What did the people of ignorance did when Abraham (may Allah be pleased with him) broke some of their idols, they threw him into fire?

 

Likewise, I shall not let go the one who insulted me. Someone may say: He did not know you to insult you. I will say: He has already known me when he knew that a number of Sunni Muslims believe that `A'ishah (may Allah be pleased with her) is pure and innocent by Qur'anic texts. Qur'an is the source of ordinances to me and to him, so she is his mother too by Qur'anic text. He was not afraid of Sunnis to take revenge of him; moreover he belittles our minds. I shall sue him because he did not revile her in a gathering of his people but in a public meeting for which he gathered people and brought mass media to deliver his voice to every Muslim and non-Muslims all over the world, whereas he remains safe in his bed!

 

I shall sue him because he has accused her with adultery, applying adornment, and backbiting, in addition to accusing her of killing the Prophet (peace be upon him), which is called, according to the positive law, insult and defamation.

 

Not only he defamed and insulted her, but also accused her of lying, slandering, and defamation accompanied by oath, thus he committed a false oath.

 

Each man and woman of the Muslim nation should believe that he or she has been insulted personally when he insulted our mother `A'ishah. We should not belittle that matter as old saying goes: if your enemy is an ant, do not belittle it. Each one should fight as much as he can and we must unite our word. He has to be punished by lashing so that he may be an example to those who dare to insult others. We should not leave him without punishment because he will be the pioneer for everyone wants to insult others and parades his bad words and slanders against others.
