$ 10M suit asserts anti-Muslim bias at Apple Store on Staten Island Mall

A Muslim man from Brooklyn is reportedly suing Apple for $10 million after employees at its New Springville location allegedly tossed him and his daughter from the store because of their religion, according to a lawsuit .

Elsayad Sobhi, 48, of Bay Ridge, apparently traveled to the Staten Island Mall on Dec. 20, 2010, to have his iPhone repaired at the Apple Store. He alleges he and his teenage daughter were thrown out of the store because she was wearing a religious headdress, according to a report from DNAinfo.com New York .

The employee repairing the smart phone reportedly refused to continue his work after seeing Miss Sobhi's headdress, the lawsuit says. Other employees also allegedly made threats against the family and tried to detain them for "undisclosed reasons," before eventually asking them to leave the store, according to the report from DNA info .

The Sobhis' lawyer, Theodore Alatsas, refused to comment on the case when the Advance reached him by phone at his Brooklyn office on Tuesday afternoon. He said his firm has not yet served the complaint to Apple, and that he could not speak openly about the case until then .

DNAinfo.com reported that the lawsuit was filed March 15 in Brooklyn Supreme Court .

The action alleges the father and daughter were "refused service by virtue of their Muslim identities," DNA info reported .

Apple could not be reached for comment.
