Come to the arbitration of the Shari`ah

A call to the people of influence and power, i.e., Hamas movement, and all Muslims in Gaza:

In the name of Allah, the Most Gracious, the Most Merciful. All praise be to Allah and peace be upon the Messenger of Allah (peace be upon him).

O our dear citizens of Gaza, the land of Jihad around Bayt Al-Maqdis (Palestine) which Allah blessed.

Good news for you, storms and earthquakes inflicted you heavily, but you stood firmly as patient people do. Those patient feel the greatness of Allah and Allah is truthful in His Promise when He says: "O you who believe! Seek help in patience and As-Salât (the prayer). Truly! Allâh is with As-Sâbirûn (the patient). * And say not of those who are killed in the Way of Allâh, "They are dead. Nay, they are living, but you perceive (it) not." * And certainly, We shall test you with something of fear, hunger, loss of wealth, lives and fruits, but give glad tidings to As-Sâbirûn (the patient). * Who, when afflicted with calamity, say: Truly! To Allâh we belong and truly, to Him we shall return. * They are those on whom are the Salawât (i.e. who are blessed and will be forgiven) from their Lord, and (they are those who receive His) Mercy, and it is they who are the guided ones." [Surat Al Baqarah: 153 - 157].

 

How far these conspiracies can affect those who responded to the command of Allah! Those patient people did not neglect, grieve, and ponder over great blessings which have been given along with afflictions: "So do not become weak (against your enemy), nor be sad, and you will be superior (in victory) if you are indeed (true) believers. * If a wound (and killing) has touched you, be sure a similar wound (and killing) has touched the others. And so are the days (good and not so good), We give to men by turns, that Allâh may test those who believe, and that He may take martyrs from among you. And Allâh likes not the Zâlimûn (polytheists and wrong-doers). * And that Allâh may test (or purify) the believers (from sins) and destroy the disbelievers. * Or do you think that you will enter Paradise before Allâh tests those of you who fought (in His Cause) and (also) tests those who are As-Sâbirûn (the patient)?" [Surat Al `Imran: 139 - 142].

 

Brethren of faith:

It is not hidden from you that Islam is the religion of Allah which He satisfied for His Servants which means submission to Allah (Glory be to Him), submissiveness to His Shari`ah, and embracing Islam unlike those who follow the accursed Satan and believed in some Ayahs while disbelieving in others: "O you who believe! Enter perfectly in Islâm (by obeying all the rules and regulations of the Islâmic religion) and follow not the footsteps of Shaitân (Satan). Verily, he is to you a plain enemy." [Surat Al Baqarah: 208].

 

It is not hidden from you that one of the pillars of Islam is to apply His Shari`ah and submission to His Ruling: "And in whatsoever you differ, the decision thereof is with Allah (He is the ruling Judge)." [Surat Ash-Shura: 10].

"Surely, We have sent down to you (O Muhammad peace be upon him) the Book (this Qur'ân) in truth that you might judge between men by that which Allâh has shown you (i.e. has taught you through Divine Revelation), so be not a pleader for the treacherous." [Surat An-Nisa': 105].

Allah (Glory be to Him) prohibited the believers to follow the whims of hypocrites who want to try them and turn them away from the revelation of Allah. Allah (Glory be to Him) says: "And so judge (you O Muhammad peace be upon him) between them by what Allah has revealed and follow not their vain desires, but beware of them lest they turn you (O Muhammad peace be upon him) far away from some of that which Allah has sent down to you. And if they turn away, then know that Allah's Will is to punish them for some sins of theirs. And truly, most of men are Fasiqun (rebellious and disobedient to Allah). * Do they then seek the judgment of (the Days of) Ignorance? And who is better in judgment than Allah for a people who have firm Faith." [Surat Al Ma'idah: 49 - 50].

 

Allah (Glory be to Him) says: "Have you not seen those (hypocrites) who claim that they believe in that which has been sent down to you, and that which was sent down before you? They wish to go for judgment (in their disputes) to the Tâghût (false judges) while they have been ordered to reject them. But Shaitân (Satan) wishes to lead them far astray. * And when it is said to them: "Come to what Allâh has sent down and to the Messenger (Muhammad peace be upon him)," you (Muhammad peace be upon him) see the hypocrites turn away from you (Muhammad peace be upon him) with aversion. * How then, when a catastrophe befalls them because of what their hands have sent forth, they come to you swearing by Allâh, "We meant no more than goodwill and conciliation!"" [Surat An-Nisa': 60 - 62].

 

Allah (Glory be to Him) warned the believers against abandoning arbitration to the Shari`ah for the fear of people. Allah (Glory be to Him) says: "Therefore fear not men but fear Me (O Jews) and sell not My Verses for a miserable price. And whosoever does not judge by what Allâh has revealed, such are the Kâfirûn (i.e. disbelievers - of a lesser degree as they do not act on Allâh's Laws)." [Surat Al Ma'idah: 44].

He explained that disbelievers abandon guidance under the pretext of fear from harm and fighting. Allah (Glory be to Him) says: "And they say: If we follow the guidance with you, we would be snatched away from our land." [Surat Al Qasas: 57]. Allah (Glory be to Him) appeases the people of faith by His Saying: "Is not Allah Sufficient for His slave? Yet they try to frighten you with those (whom they worship) besides Him! And whom Allah sends astray, for him there will be no guide. * And whomsoever Allah guides, for him there will be no misleader. Is not Allah All-Mighty, Possessor of Retribution?" [Surat Az-Zumar: 36 - 37].

 

The command with applying the Shari`ah and warning against other laws are clear and manifest as they are parts of the Shari`ah. It is not proper to disable the application of Shari`ah for doubts that decieve minds with nice speech and turn facts upside down away from the texts of the Shari`ah. "It is He Who has sent down to you (Muhammad peace be upon him) the Book (this Qur'ân). In it are Verses that are entirely clear, they are the foundations of the Book [and those are the Verses of Al-Ahkâm (commandments), Al-Fara'id (obligatory duties) and Al-Hudud (legal laws for the punishment of thieves, adulterers)]; and others not entirely clear. So as for those in whose hearts there is a deviation (from the truth) they follow that which is not entirely clear thereof, seeking Al-Fitnah (polytheism and trials), and seeking for its hidden meanings." [Surat Al `Imran: 7]. "And when it is said to them: "Make not mischief on the earth," they say: "We are only peace-makers."" [Surat Al Baqarah: 11].

 

Good intentions do not correct corrupted actions and do not change the fact of sedition. Having good thinking of Muslims does not mean negligence in the crutches of Shari`ah and imitating the old is not governing to the Shari`ah, but verily, the Shari`ah governs sayings and actions. Coping with administrative rules to which the West call are not a plea in the religion of Allah, and every person should beware of abandoning the command of Allah for fear of turning his heart away from the truth. "O you who believe! Answer Allâh (by obeying Him) and (His) Messenger when he (peace be upon him) calls you to that which will give you life, and know that Allâh comes in between a person and his heart (i.e. He prevents an evil person to decide anything). And verily, to Him you shall (all) be gathered. * And fear the Fitnah (affliction and trial) which affects not in particular (only) those of you who do wrong (but it may afflict all the good and the bad people), and know that Allâh is Severe in punishment. * And remember when you were few and were reckoned weak in the land, and were afraid that men might kidnap you, but He provided a safe place for you, strengthened you with His Help, and provided you with good things so that you might be grateful. * O you who believe! Betray not Allah and His Messenger, nor betray knowingly your Amanat (things entrusted to you, and all the duties which Allah has ordained for you)." [Surat Al Anfal: 24 - 27].

 

Dear Muslims brothers in Hamas movement:

Applying the Shari`ah of Allah is a response to Allah's Commands, holding firm with His Rope, collecting the diaspora of the people of goodness, exposure to hypocrites, vexation to disbelievers, good news for Muslims, and knowing the status of blood that was spilled out in every walk of life which demands the arbitration of the Shari`ah; so come to the application of Allah's Shari`ah as a just judge, and keep to your promises. Did not you claim that you are the Islamic resistance movement which adopts Islam as a method and from which they extract their ideas and concepts about the universe, life, and man, and to which they resort in arbitration and from which they extract their guidance.

 

Let it be known that the legitimacy is extracted from the Shari`ah arbitration and distinction between the way of Allah and the way of Satan. "The only saying of the faithful believers, when they are called to Allah (His Words, the Quran) and His Messenger (peace be upon him), to judge between them, is that they say: We hear and we obey. And such are the prosperous ones (who will live forever in Paradise)." [Surat An-Nur: 51].

"And if you turn away (from Islâm and the obedience to Allâh), He will exchange you for some other people and they will not be your likes." [Surat Muhammad: 38].
